The below Non-Disclosure Agreement (NDA) applies to all restricted datasets in the Administrative Data Research Facility (ADRF). Please note that some datasets may require an additional agreement and/or further approval for use, as noted in the ADRF Explorer.

I ________________________ acknowledge all outlined requirements in the following Non-Disclosure Agreement and agree to abide by all applicable state and federal status and rules and all Department policies and rules.

  • All data accessed during the Executive Program of Applied Data Analytics is confidential and must be protected from unauthorized disclosure and use. Thus, I agree that any rights of privacy, confidentiality and protection from harm are met in accordance with accepted professional and scientific ethics.  
  • I have been instructed by program Faculty on the permissible use of the data and will not use the data for any other purpose.
  • I understand that I may not share the data with any other entity or person, including but not limited to other employees, agents or contractors of participating institutions in the Executive Program of Applied Data Analytics who are not authorized to access the data. I have received instructions from program Faculty on the proper way to manage and protect the confidentiality of the data and shall take all necessary steps to reduce the risk of unauthorized disclosure or use.
  • I agree to permit the Agency which provides the Data for the program to monitor the research project.
  • I understand that I must report all violations to the Executive Program of Applied Data Analytics which in turn will contact the respective Agency and initiates.
  • I understand that any violation of this NDA may result in suspension of the research and prohibition of any further study as well as in a referral of the matter to the appropriate governmental authorities.
  • I understand that I will be responsible for any violation that leads to re-identification of personal information or unauthorized data access comply with possible penalties in case of breaches
  • I shall fully cooperate with any investigation conducted by the City, any other governmental authority, or a City Agency or its designated agents in relation to unauthorized use or disclosure or security incident.
  • I shall bear all costs related to its investigation of any unauthorized use or disclosure or security incident related to: (1) providing notice to individuals affected by such unauthorized use or disclosure or security incident; and (2) all reasonably measures in mitigation of the harmful effects of such unauthorized use or disclosure or security incident including, but not limited to, credit monitoring services for the affected individuals, and any other preventive measure.
  • In case of disclosing IDES data to any unauthorized entity I shall be guilty of a Class B misdemeanor and may be required to serve up to 6 months in jail and pay a fine up to $1,500. I shall also be disqualified from holding an appointment or employment with the state.
